Terms of Service

These Terms of Service ("Terms") govern your use of the CuevasLab website at shop.cuevaslab.es and any purchases you make through it. By accessing or using our website, you agree to be bound by these Terms.

Please read them carefully before placing an order.

1. About Us

CuevasLab is an online retail business based in Madrid, Spain, selling consumer electronics, home appliances, outdoor products, and related accessories to customers within the European Union.

2. Eligibility

To use our website and make purchases, you must:

  • Be at least 18 years old (or the age of majority in your country)
  • Have a valid delivery address within the European Union
  • Provide accurate and complete information during registration and checkout

3. Products and Pricing

Product descriptions

We make every effort to ensure that product descriptions, images, and specifications on our website are accurate. However, we do not warrant that they are completely error-free. If you receive a product that differs materially from its description, you are entitled to a return and refund.

Pricing

  • All prices are displayed in Euros and include VAT
  • Prices may change at any time, but changes will not affect orders that have already been confirmed
  • In the event of a pricing error, we will notify you before processing the order and give you the option to cancel

Availability

All products are subject to availability. If a product becomes unavailable after you place an order, we will notify you promptly and offer a full refund.

4. Orders and Payment

Placing an order

When you place an order through our website, you are making an offer to purchase the selected products. An order confirmation email does not constitute acceptance of your order. The contract is formed when we dispatch the products and send you a shipping confirmation.

Payment methods

We accept:

  • Credit/debit cards (Visa, Mastercard, American Express) via Stripe
  • Bank transfer
  • Cash on delivery (COD) for select regions

All card payments are processed securely by Stripe (PCI DSS Level 1 certified). We never store your card details.

Order cancellation

You may cancel an order before it has been dispatched by contacting us at support@cuevaslab.es. Once dispatched, you may exercise your right of withdrawal (see Section 6).

5. Shipping and Delivery

We ship to all 27 EU member states. Delivery times and methods are detailed on our Shipping & Returns page.

  • Risk of loss passes to you upon delivery
  • Ownership of the products transfers to you upon full payment
  • If delivery fails due to an incorrect address provided by you, additional shipping charges may apply

6. Right of Withdrawal (14-Day Return Policy)

Under EU Directive 2011/83/EU, you have the right to withdraw from your purchase within 14 calendar days of receiving the goods, without giving any reason.

To exercise this right:

  1. Contact us at support@cuevaslab.es within the 14-day period
  2. Return the item in its original condition and packaging
  3. We will refund the full purchase price within 14 days of receiving the returned item

Exceptions: The right of withdrawal does not apply to:

  • Sealed goods that have been opened after delivery where return is not possible for hygiene or health protection reasons
  • Goods that have been personalized or made to your specifications

7. Warranty and Conformity

All products are covered by the EU legal guarantee of conformity (minimum 2 years) under Directive 2019/771. Details are available on our Warranty page.

If a product is defective or non-conforming:

  • Within the first year, the defect is presumed to have existed at delivery
  • You are entitled to repair, replacement, or refund at no additional cost

8. User Accounts

Account creation

You may create an account to access features like order tracking, saved addresses, and faster checkout. You are responsible for maintaining the confidentiality of your account credentials.

Account security

  • Notify us immediately if you suspect unauthorized access to your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

Account deletion

You may request account deletion at any time by contacting us at privacy@cuevaslab.es.

9. Intellectual Property

All content on our website -- including text, images, logos, product descriptions, design elements, and software -- is owned by CuevasLab or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages arising from your use of our website or products
  • Our total liability for any claim is limited to the amount you paid for the specific order in question
  • Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law

11. Dispute Resolution

Governing law

These Terms are governed by the laws of Spain and the European Union.

Consumer disputes

As an EU consumer, you have the right to submit disputes to the Online Dispute Resolution (ODR) platform provided by the European Commission: https://ec.europa.eu/consumers/odr

You may also contact the consumer protection authorities in your country of residence.

Jurisdiction

Any disputes that cannot be resolved amicably will be subject to the jurisdiction of the courts of Madrid, Spain, without prejudice to any mandatory consumer protection rules in your country.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of our website after changes constitutes acceptance of the revised Terms.
